Terms and Conditions for Relationships Are Forever Foundation (Known as Happy Life Foundation) online Services

Effective Date: 1^st January 2025

By accessing and using the Relationships Are Forever Foundation’s (“the Foundation”) website including the Happy Life AI chat bot (“Services”), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you are prohibited from using our online Services. Our online Services are designed to assist users in applying the Happy Life Toolkit, which includes resources such as Friendship cards, On Our Journey, Connecting Colleagues, Couple Cards, First Years, and Therapy cards.

The terms ‘Happy Life’, ‘Happy Life Foundation, Relationships Are Forever Foundation  ‘us’ or ‘we’ refers to the owner of the website whose address is 43/3 Censu Tabone Street, St Julian Malta STG 1018.

1. Acceptance of Terms

By registering for and using our online Services, you confirm that you have read, understood, and agree to these Terms and Conditions. You also agree to comply with the Foundation’s Privacy Policy, which are incorporated by reference into this document.

2. Purpose of our online Services

Our online Services are intended to serve as a guide to help users apply the Happy Life Toolkit. It is not a substitute for professional advice, therapy, or assistance that would otherwise be provided by qualified professionals in the caring industry. Our online Services are designed to provide general guidance and should not be used as therapy or professional support.

3. User Responsibilities

• Limitations of Use: You acknowledge that our Services are not a substitute for professional advice or therapy. If you require professional assistance, you should consult a qualified professional.
• Accuracy of Information: You agree to report any incorrect or misleading information provided by our Services to the Foundation. The Foundation is not responsible for any consequences arising from the misinterpretation or misuse of information provided by our Services.
• Prohibited Uses: You may not use our Services for any illegal, harmful, or abusive purposes. You may not attempt to reverse engineer, decompile, or otherwise tamper with software or underlying technology our Services utilise.
• Prohibition of Harmful Content: Users are prohibited from inputting any harmful, abusive, or illegal content on the Happy Life website and anything regarding its online Services. The Foundation reserves the right to monitor and block any such content.

4. Data Collection and Priv

Your use of our Services is also governed by the Happy Life Privacy Policy (https://happylife.org.mt/privacy-policy/), which outlines how your personal information is collected and used by us and includes your rights as a data subject.

5. Disclaimer of Liability

• No Warranty: Our online Services and the information provided are provided “as is” without any warranties, express or implied. The Relationships Are Forever Foundation does not guarantee the accuracy, completeness, or reliability of the information provided by the chatbot.
• No Guarantee of Accuracy: The Foundation does not guarantee the accuracy or reliability of our online Service’s responses. Users should exercise their own judgment when applying any information provided by our online Services.
• Limitation of Liability: The Foundation shall not be liable for any damages, including but not limited to direct, indirect, incidental, or consequential damages, arising from the use or inability to use our online Services. This includes any damages resulting from our online Services’ misinterpretation or misuse of information.
• Third-Party Links: The online Services may contain links to third-party websites or resources. The Foundation is not responsible for the content or accuracy of these external sites; your use of them is at your own risk.

6. Intellectual Property

• Ownership: All materials, including but not limited to the chatbot, the Happy Life Toolkit, and any related content, are the property of the Foundation and are protected by copyright and trademark laws.
• License: You are granted a limited, non-exclusive, non-transferable license to use our online Services and the Happy Life Toolkit for personal, non-commercial purposes only. You may not modify, copy, distribute, or create derivative works based on the chatbot or the Toolkit without the Relationships Are Forever Foundation’s prior written consent.

7. Termination

The Relationships Are Forever Foundation reserves the right to terminate or suspend your access to our online Services at any time, without notice, for any reason, including but not limited to violations of these Terms and Conditions. Upon termination, you must cease all use of our Services and destroy any materials obtained from it.

8. User Age Restrictions

Our online Servicesare not intended for use by individuals under 18. By using our online Services, you confirm that you are at least 18 years old.

If you are under 18, you must have parental consent to use our online Services. The youngest age a person can use our online Services with parental consent, is 13 years old.

9. Indemnification

You agree to indemnify and hold the Relationships Are Forever Foundation harmless from any claims, damages, or liabilities arising from your use of our online Services, including any misuse of the information provided by our online Services.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Malta, without regard to its conflict of law provisions. Any disputes arising from the use of our online Services shall be subject to the exclusive jurisdiction of the courts of Malta.

11. Changes to Terms and Conditions

The Relationships Are Forever Foundation reserves the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on the Relationships Are Forever Foundation’s website. Your continued use of our online Services after any changes constitutes your acceptance of the revised Terms and Conditions.

Privacy for Happy Life

One of our main priorities at the Relationships Are Forever Foundation (known as Happy Life Foundation) – https://happylife.org.mt – is the privacy of our users and we are strongly committed to keeping secure any information we obtain from you or about you. This Privacy Policy describes our practices with respect to Personal Data that we collect from or about you when you use the Happy Life website, Learning Management Services, the Happy Life AI Chat Bot and any services that you may receive from Relationships Are Forever Foundation  (“Services”).

This Privacy Policy applies only to our online activities in relation to our Services with regards the information that you have shared and/or collect on the Happy Life website. This policy is not applicable to any information collected offline or via channels other than this website.

1. Data Controller

Happy Life (“Relationships Are Forever Foundation”) with its registered address (“43/3 Censu Tabone Street, St Julian, STG 1018 Malta”) is the controller and is responsible for the processing of your Personal Data as described in this Privacy Policy.

 We collect personal data relating to you (“Personal Data”) as follows:

Personal Data You Provide: We collect Personal Data if you create an account to use the services including but not limited to Happy Life AI Chat Bot or communicate with us as follows:

1. Account Information: When you create an account with us, we will collect information associated with your account, including your name, contact information, account credentials, date of birth (collectively, “Account Information”).
2. User Content: We collect Personal Data that you provide in the input to our Services (“Content”), including your prompts and respective replies.
3. Communication Information: If you communicate with us, such as via email or our pages on social media sites, we may collect Personal Data like your name, contact information, and the contents of the messages you send (“Communication Information”).
4. Other Information You Provide: We collect other information that you may provide to us, such as when you participate in our events or surveys or provide us with information to establish your identity or age (collectively, “Other Information You Provide”).
5. Personal Data we receive from your use of Happy Life Services: When you visit, use, or interact with the Happy Life Services, we receive the following information about your visit, use, or interactions (“Technical Information”):

 

• Log Data: We collect information that your browser or device automatically sends when you use our Services. Log data includes your Internet Protocol address, browser type and settings, the date and time of your request, and how you interact with our Services.

3. How is your Personal Data used?

Unless required by law we will maintain and use de-identified information in de-identified form and not attempt to reidentify the information.

We may need to disclose your Personal Data in the following circumstances:

• Vendors and Services Providers: to assist us in meeting our operations and to perform certain services and functions we may need to disclose Personal Data to vendors and service providers, including providers of hosting services, customer service vendors, cloud services, content delivery services, support and safety monitoring services, email communication software, web analytic services, and other information technology providers. In line with our instructions, these parties will access, process, or store Personal Data only in the court of performing their duties for us.
• Government Authorities or Other Third Parties: we may need to share your Personal Data, including information about your interaction with our Services, with government authorities or other third parties in compliance with the law (i) if required by a legal obligation (ii) to protect and defend our rights or property (iii) if there is, in terms our discretion, a violation of our terms, policies or the law; (iv) to detect or prevent fraud or other illegal activities; (v) to protect the safety, security and integrity of the platform, employees, users, or the public, or (vi) to protect against legal liability.

 

5. Retention

We won’t hold on to your Personal Data infinitely and will only hold on to what is necessary for us to deliver our Services or to fulfil other legitimate needs such as resolving disputes, ensuring safety and security, or meeting legal requirements. Once it is no longer required to keep such Personal Data, then it will be destroyed or erased from our systems. The length of retention of your Personal Data will depend on a number of factors including:

• The purpose for processing the data i.e. retain the data to provide you with our Services;
• Amount, nature and sensitivity of the information;

If you have any unresolved complaints with us, you can reach out to the Information for Data Protection Commissioner, as the supervisory authority in Malta, or your local supervisory authority.

7. Minors

Our Services are not directed to, or intended for, children under 13.  We do not knowingly collect Personal Data from children under 13. If you have reason to believe that a child under 13 has provided Personal Data through the Services, please email us at (email address)⁠. We will investigate any notification and, if appropriate, delete the Personal Data from our systems. Users under 18 must have permission from their parent or guardian to use our Services.

8. Security

We have in place reasonable technical, administrative, and organizational safeguards to protect Personal Data against loss, misuse, and unauthorized access, disclosure, alteration, or destruction. You should always be careful with what you share on the internet, and we suggest that you don’t share any Personal Data unless necessary since nothing on the internet is entirely secure or error free. Additionally, we cannot be held responsible for any circumvention of privacy settings or security measures implemented on our Services or on third-party websites.
